Immigration Lawyers in Tampa, Florida – Sham Marriages?

A Tampa immigration lawyer deals with many immigration issues, including fiancé visas for marriage. Immigration laws are not made by each state; they are federal- applying equally to all Americans. So immigration lawyers in Tampa, Florida deal with the same laws concerning immigration as immigration lawyers in Alaska.

There are a few different ways a United States citizen can marry someone from another country and it will be legal. Marrying someone from another country is okay in the U.S. governments eyes, as long as it is done for the right reasons- love. One story I read is about a Tampa couple who went through a nightmare while being interviewed at the U.S Citizenship and Immigration Services office, and had to end up hiring an immigration lawyer in Tampa where they lived.

While at the meeting agents pounded them with questions, many the couple were not in agreement with each other, and accused the marriage of being a sham. The Tampa immigration lawyer who accepted their case said he believes the couple married for love, and says he turns down cases where the parties admit they married solely for the purpose of the immigrant receiving a green card. There were plenty of people willing to testify the marriage was real. I don’t know the outcome after the Tampa immigration lawyer filed an appeal, but the woman was first denied her green card.

This goes to show how serious the U.S. is about stopping illegal immigrants from entering the U.S., where usually the citizen is paid to get married. At the time (2007), the head of the Office of Fraud Detection and National Security said the going rate for one of these ‘arranged’ marriages was between $10,000 and $35,000- definitely not pocket change.

The agents said there are ways they can tell if the marriage is a sham- living in separate bedrooms, no joint checking accounts, no bills in both names, and more. In the mentioned article it said there have been two major busts involving sham marriages. I am sure more than one Tampa immigration lawyer was contacted, plus those out of Tampa and even Florida, and all were busy because they were big operations and involved many citizens and immigrants in a number of different states.

If a U.S. citizen marries someone while in another country, and the country recognizes it, the marriage will be considered valid by the U.S. government; mainly because other countries are stricter about marriage than the U.S. A U.S. citizen may also apply for a K-1 fiancé visa, which is used to provide the citizen’s fiancé entry into the U.S. for the purpose of marriage. The couple must have seen each other within the past two years, although some exceptions apply (such as a country where it is customary not to see each other before marriage), and once the fiancé is in the U.S. the couple must marry within 90 days.

Fiance (k-1) visas usually take anywhere from 3 to 4 months to get approved, providing everything is correct and all items check out. However, it is not uncommon for paperwork to be incorrect and there can be a significant time delay- sometimes up to or exceeding 12 months. This is one specialty of immigration lawyers in Tampa and every other city in the United States- making sure paperwork is correct, being a representative for the couple to overcome obstacles, and help speed up the process.

If someone is visiting from another country; via work, travel, or a student visas, then meets a U.S. citizen and they plan to marry, the foreigner can file for an adjustment of status from a non-immigrant to a permanent resident. If a foreigner comes to the U.S. with the intention on marrying a U.S. citizen, but enters the U.S. using a non-immigrant visa (travel or student), the non-immigrant will have to go back to his or her home country and apply for a K-1 visa or risk legal problems.

Some of the charges an issue like the one in the paragraph above, as well as marrying for money or for a green card, the parties can face are visa fraud, falsifying documents, marriage fraud, conspiracy, and making false statements. According to the head of the Office of Fraud Detection and National Security, when threatened with these charges and a 15-30 year prison sentence the U.S. citizen involved usually ‘cracks’ if the marriage is a sham. He also said 95% of fraud in the Tampa area is marriage fraud, which is definitely keeping immigration lawyers in Tampa busy!

The difference between a timeshare and a ‘normal’ hotel room can be quite significant. When I say ‘normal’ hotel room I mean the typical room where everything is in one room plus a bathroom.

The closest a hotel room comes to a timeshare is if the hotel room is a one bedroom suite, or if the timeshare is a studio. Still, there are some major differences. I just found out (or remembered due to something in the mail) that University of Phoenix is having my graduation commencement ceremony next Saturday, September 25 at Amway Center in Orlando, Florida. What a great college!  I love the way the classes are structured, I would have still been going to a traditional college because when I had a health issue I would have to drop all of my classes and wait until the next semester; not at UoP, the most I would wait is about four to five weeks, but usually less!

I had not planned on going because I really wanted to be able to at least stand or better yet walk a few steps, so I figured it would be better to go when I get my master’s degree. But, it took me ten years to get my bachelor’s degree, however I don’t plan on it taking it nearly as long to get my master’s; the program is about a year and a half.

If you have read my about me section you know it has been a battle since my accident in 1999, so finally graduating college is a big accomplishment for me!

I have been really busy getting my business up and running and do not want to be distracted until I get it running smoothly. I have been learning so much new stuff and one goal is to post fresh, quality content on here about 2 or 3 times a week so you can learn as much as possible about internet marketing. In my opinion everyone needs to at least learn a little about it. If you have a business and do not have a presence online you are really missing the boat!

It has been a rough month. My best friend, who meant a lot to me, passed away on August 14, 2010. He was diagnosed with Duchene’s Muscular Dystrophy when he was eight years old. The doctors originally told him he would not live past fifteen. He had just turned 24 this past June, so he outlived the doctors expectations by nine years; which is nine more years we got to spend with him.

I was very lucky to meet his father, who introduced me to T.C. When I first met his dad Troy, I was severely depressed, did not get out of bed for about a year, and was contemplating suicide because I was having a hard time dealing with living with a spinal cord injury and life in a wheelchair. When I met T.C. and saw how happy he was, even though he could barely move anything, I thought to myself  “why am I depressed?” From then on we were the best of friends and I did all I could to keep him active and happy, which also helped me.

His family is like a second family to me and I usually went to Indiana with them to visit the rest of his family. Going to Indiana for two weeks for the funeral was hard for me, just knowing I wouldn’t see him again..at least physically. I know we will see each other again, but there is still a void in my life because he was a big part of it for many years!

Here’s to you T.C.! Rest in Peace and I will see you soon!

WOW! That is so sad! This really hits home with me. It is days like this that make me feel fortunate, even though life in a wheelchair gets very frustrating, that I feel fortunate to be alive after my accident.

I am not sure how old the guy was, but I seem to remember the news saying he was fairly young. The weird thing is that he was doing circles with his Jet Ski (so was I not long before my accident) and somehow he ended up falling off and I guess he never came up. He did not have a life jacket on, so if he happened to hit his head on the steering or any other part of the ski he could have been knocked out.

Just to clarify, my accident did not happen while I was riding my Jet Ski, two friends were while I was getting ready to put it on the trailer. Some people can be really reckless driving jet skiis and boats, I am glad to see a new Jet Ski has brakes.

Most accidents happen because people forget there are no brakes and do not slow down enough and hit someone, something, or run ashore like I did the first day I bought mine. I still think the throttle cable was stuck because I had ridden jet skiis many times before and was well aware of how they stopped. I came to shore so fast that when the ski hit land I jumped at the same time and ended up running so fast up the causeway so I did not eat the pavement!

I just want to caution everyone with summer coming up, whether riding a jet ski, driving a boat, going to clubs and drinking, or whatever it is you do for fun, please be careful! If you have kids, please reiterate to them to think first, consider the consequences.

My accident happened in the blink of an eye. Although I was not doing anything reckless, just playing around at the shore line, that instant has changed my life completely! Do I wish it never happened, sure I do; but at the same time it was a learning experience and has brought me down a path I am very grateful for!

I have been working on setting up some training, a newsletter, ebooks, and video courses.  While I was searching for content I came across an article which really got me thinking about internet marketing and the power of social media.

The article was about Jim Carrey and Jenny McCarthy.  It is sad to see they are splitting up, but what shocked me was how they announced it!  Usually you hear about celebrities splitting up in gossip magazines, or places like TMZ.com, but Jim and Jenny used Twitter to announce their split!

I guess I shouldn’t be all too surprised.  Jim Carrey and Jenny McCarthy announcing their split on Twitter got in in the open and probably saved them from having the rumor mills open and a bunch of unwanted gossip spread which is usually the case in celebrity splits-ville.

I am not sure how many Twitter followers Jim Carrey and Jenny McCarthy have, but I assume it is quite a bit.  If Ashton Kutcher has over one million, I bet Jim and Jenny are pretty close especially added together.

Realizing, a even better harnessing, the power of social media to use for internet marketing and a home-based business, is a wonderful traffic source and an easy way to make money online if you can be consistent.  Not only can you make money and work from home, but you can meet people you would probably never meet without the power of Twitter, FaceBook, MySpace, and other social media sites.

As I am sure most guys my age have, I had a crush Jenny McCarthy going way back, all the way to her host Singled Out on MTV.  I guess now there is a chance for me once again.  Jenny, if you see this…call me!!  8-p

It is amazing to think the economy is in a slump!  I have basically tied myself to my desk these last few months so I can move forward as fast as possible!  I am learning so much!  I told my mom earlier that I have learned more in the past few months than I have in ten years of being on the internet!

I know it may be hard to understand, but as bad as the economy is in the everyday world, it does not seem to exist on the internet.  There are more millionaires made in hard times than there are when the economy is booming.  I think the reason is because when people are down and out they tend to think creatively, which can lead to some great ideas!  All it takes is you believing in yourself and staying committed and focused and you can do anything you set your mind to!

I have been working on putting together training material and other information that will be helpful to everyone who visits here.  It will start with many forms of internet marketing basics; including blogging, search engine optimization (SEO), article marketing, video marketing, social media marketing, and any other form of media I am use as well as references to other sites and products which have helped me. You can never learn too much and if you get just one valuable piece of information from a product I would consider it time well spent!  No matter how irrelevant the information seems at the time, it may come in handy down the road when you least expect it, as it has me.
